1. Introduction

Welcome to Ludivo.

Ludivo is a Software as a Service (SaaS) platform operated and provided by LIGHT GAMIFICATION TECNOLOGIA LTDA, registered in Brazil under CNPJ 66.871.451/0001-02, hereinafter referred to as "Light Gamification", "we", "our", or "us".

These Terms of Service ("Terms") govern your access to and use of the Ludivo platform, website, applications, and related services.

By creating an account, accessing, or using Ludivo, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the platform.

2. Description of the Service

Ludivo is a gamification platform designed primarily for educational environments, enabling teachers, schools, institutions, and individuals to create engaging experiences through game-inspired mechanics.

The platform may include, among other features:

• User accounts and profiles;
• Groups and classroom management;
• Gamification systems;
• Quests, rewards, and achievements;
• Educational tools and resources;
• Premium subscription features;
• Institutional plans and services.

Ludivo may evolve over time, and features may be added, modified, or removed at our discretion.

3. Eligibility and Accounts

Anyone may create an account and use Ludivo.

By creating an account, you represent that:

• The information you provide is accurate and current;
• You are authorized to create and manage the account;
• You will maintain the security of your login credentials;
• You are responsible for activities conducted through your account.

You are responsible for keeping your account information up to date.

4. User Information and Educational Data

Users may provide information including:

• Name;
• Email address;
• Optional profile information;
• Location;
• Date of birth;
• Educational information;
• Avatars and profile customization data.

Institutional users may also store academic information such as grades and classroom-related data.

Users and institutions remain responsible for the accuracy, legality, and authorization of any information entered into the platform.

Light Gamification provides the platform infrastructure but does not verify or validate user-submitted information.

5. Plans and Subscriptions

Ludivo may offer:

• Free Plan — a free plan with limited features that may be modified at any time.
• Premium Plan — a paid monthly subscription that unlocks additional features and functionality. Premium subscriptions are billed through our payment provider, Paddle.
• Institutional Plans — institutional plans are offered through direct commercial contact and may be subject to separate agreements, pricing, or contractual terms.

6. Payments and Billing

Payments for Premium subscriptions are processed by Paddle or other authorized payment providers.

By purchasing a subscription, you agree to:

• Provide valid payment information;
• Authorize recurring billing where applicable;
• Comply with the payment provider's terms and policies.

Pricing may change in the future. Any changes will not affect previously completed billing periods.

7. Cancellation

Users may cancel Premium subscriptions at any time.

Unless otherwise specified, cancellation prevents future renewals while maintaining access to Premium features until the end of the already-paid billing period.

Refund requests, when applicable, are governed by our separate Refund Policy.

8. Acceptable Use

Users must use Ludivo responsibly and lawfully.

The following activities are prohibited:

• Violating applicable laws or regulations;
• Uploading illegal content;
• Harassment, abuse, or threats;
• Hate speech or discriminatory conduct;
• Infringing intellectual property rights;
• Unauthorized access attempts;
• Security testing without authorization;
• Distribution of malware or malicious software;
• Impersonation of other individuals or organizations;
• Activities intended to disrupt the platform or other users.

We reserve the right to investigate suspected violations.

9. User Content

Users retain ownership of the content they submit to the platform.

By submitting content, you grant Light Gamification the limited rights necessary to:

• Store the content;
• Process the content;
• Display the content within the platform;
• Provide the services requested by the user.

Users are solely responsible for the content they create, upload, or share.

10. Intellectual Property

Ludivo and its associated materials, including but not limited to:

• Software;
• Source code;
• User interface;
• Visual identity;
• Trademarks;
• Logos;
• Texts;
• Graphics;
• Designs;
• Documentation;

are owned by Light Gamification or its licensors and are protected by applicable intellectual property laws.

Users may not:

• Copy;
• Modify;
• Reverse engineer;
• Resell;
• Redistribute;
• Reproduce;
• Create derivative works from;

any part of the platform without prior written authorization.

11. Third-Party Services

Ludivo may integrate with third-party services, including:

• Paddle (payment processing);
• Google Login (authentication services).

Use of these services may be subject to their own terms, privacy policies, and operational requirements.

Light Gamification is not responsible for the operation, availability, or policies of third-party providers.

12. Service Availability

We strive to keep Ludivo available and operational.

However, we do not guarantee uninterrupted availability.

The platform may experience interruptions resulting from:

• Maintenance;
• Updates;
• Infrastructure failures;
• Internet connectivity issues;
• Third-party provider failures;
• Events beyond our reasonable control.

We will make reasonable efforts to restore service as quickly as possible whenever interruptions occur.

13. Limitation of Liability

Ludivo is provided as a tool to support educational, organizational, and personal gamification activities.

Light Gamification is not responsible for:

• Educational decisions;
• Academic outcomes;
• Organizational decisions;
• User-generated content;
• Data entered by users;
• Actions taken based on information available through the platform.

To the maximum extent permitted by applicable law, Light Gamification shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of the platform.

14. Enforcement and Account Actions

If a user violates these Terms, we may take enforcement actions, including:

• First Violation — formal warning and notification.
• Repeated Violation — temporary suspension of access.
• Continued or Serious Violation — permanent account termination.

Whenever reasonably possible, users will receive prior notice regarding enforcement actions.

We reserve the right to take immediate action in cases involving security risks, illegal activity, fraud, or significant harm to the platform or its users.

15. Service Discontinuation

Light Gamification may discontinue Ludivo or any portion of its services.

Whenever reasonably possible, users will receive at least 30 days' prior notice before a permanent service shutdown.

16. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be published on the Ludivo website with a revised effective date.

Continued use of the platform after updates become effective constitutes acceptance of the revised Terms.

18. Final Provisions

These Terms constitute the entire agreement between the user and Light Gamification regarding the use of Ludivo.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms are made available in multiple languages. All language versions are intended to have equivalent meaning and legal effect.
